1. ✅ Acceptance of Terms

By creating an account, submitting content, purchasing a subscription, or otherwise accessing or using MyVibeCodedApp, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a legally binding agreement between you and MyVibeCodedApp. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. 🎂 Eligibility

To use MyVibeCodedApp, you must:

Be at least 13 years of age (or 16 in the EU/EEA)
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable law
Not have had a previous account terminated for violations of these Terms

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone for any reason at any time.

3. 👤 User Accounts

3.1 Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Use a strong, unique password
Notify us immediately of any unauthorized access to your account
Not share your account credentials with any third party
Not create multiple accounts to circumvent bans or restrictions

3.3 Account Deletion

You may delete your account at any time from your profile settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Public app submissions may be retained in anonymized form unless you explicitly request their removal.

4. 💎 Subscriptions & Payments

4.1 Subscription Plans

MyVibeCodedApp offers optional paid subscription plans ("Premium", "Pro", or similar tiers) that provide access to enhanced features. Free tier features are available to all registered users. Subscription features and pricing are described on the Subscription Plans page and are subject to change with notice.

4.2 Billing & Renewal

Subscriptions are billed on a recurring basis (monthly or annually) as selected at checkout.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
You authorize us to charge your payment method on file for each renewal period.
Prices are displayed in USD unless otherwise stated and are exclusive of applicable taxes.

4.3 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period ends.

4.4 Refunds

All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days of the charge at support@myvibecodedapp.com and we will review your case.

4.5 Failed Payments

If a payment fails, we may attempt to retry the charge. If payment cannot be collected, your subscription may be downgraded to the free tier and premium features will be suspended until payment is resolved.

5. 📤 User Content & App Submissions

5.1 Your Content

You retain ownership of all content you submit to MyVibeCodedApp ("User Content"), including app listings, descriptions, screenshots, and profile information. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the platform and in marketing materials.

5.2 Content Standards

All User Content must comply with our App Submission Agreement. You represent and warrant that:

You own or have the necessary rights to submit the content
Your content does not infringe any third-party intellectual property rights
Your content does not violate any applicable laws or regulations
Your content is accurate and not misleading

5.3 Content Moderation

All app submissions are subject to review and approval by our moderation team. We reserve the right to reject, remove, or modify any content that violates these Terms or our community standards, without prior notice and without liability.

5.4 Comments & Ratings

Comments and ratings must be honest, respectful, and relevant. Fake reviews, coordinated rating manipulation, harassment, or spam are strictly prohibited and may result in account suspension.

6. 🚫 Prohibited Conduct

You agree not to:

Submit, upload, or share content that is pornographic, sexually explicit, obscene, or adult in nature
Submit content that promotes violence, hatred, discrimination, or illegal activities
Infringe upon the intellectual property rights of others
Submit malware, viruses, or any code designed to harm users or systems
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Engage in spamming, phishing, or unsolicited commercial communications
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Use automated bots, scrapers, or crawlers to access the Service without our written permission
Manipulate ratings, reviews, or leaderboard rankings through fraudulent means
Harass, bully, or threaten other users
Circumvent any security measures or access controls
Use the Service for any unlawful purpose or in violation of any applicable laws
Resell, sublicense, or commercially exploit the Service without our written consent

Violation of these prohibitions may result in immediate account suspension or termination, removal of content, and/or legal action.

7. ©️ Intellectual Property

7.1 Our Property

The MyVibeCodedApp platform, including its design, code, branding, logos, and all content created by us, is owned by MyVibeCodedApp and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our platform without our express written permission.

7.2 Your Property

You retain full ownership of the apps and content you submit. We do not claim ownership of your submitted apps. The license you grant us (Section 5.1) is limited to operating and promoting the platform.

7.3 DMCA / Copyright Infringement

If you believe your copyrighted work has been infringed on our platform, please send a DMCA takedown notice to support@myvibecodedapp.com with the following information: (1) identification of the copyrighted work, (2) identification of the infringing material and its location on our site, (3) your contact information, (4) a statement of good faith belief, and (5) a statement of accuracy under penalty of perjury.

8. 📢 Advertising

MyVibeCodedApp displays advertisements served by Google AdSense and may display promoted/featured listings purchased by creators. By using the Service, you acknowledge and agree that:

Advertisements may be displayed throughout the platform
Ad content is provided by third parties and we are not responsible for the content of external advertisements
Clicking on advertisements may take you to third-party websites governed by their own terms and privacy policies
Premium subscribers may receive a reduced-ad experience as described in their subscription plan

Featured listings are paid placements that give apps increased visibility. Featured status does not constitute an endorsement by MyVibeCodedApp.

9. ⚠️ Disclaimers & Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Third-Party Apps

Apps listed on MyVibeCodedApp are created and submitted by independent users. We do not endorse, verify, or take responsibility for the functionality, safety, or legality of any user-submitted app. You access and use third-party apps entirely at your own risk.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYVIBECODEDAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.

9.4 User content disclaimer

We do not endorse, verify, or assume responsibility for any user-submitted content, including but not limited to apps, media files, comments, or other materials. Such content is the sole responsibility of the user who submitted it.

9.5 Data & Security

We are not responsible for any loss of data, content, or materials uploaded to the Service. You are solely responsible for maintaining backups of your content. We are not responsible for unauthorized access to your account resulting from your failure to maintain the confidentiality of your credentials.

10. 🛡️ Indemnification

You agree to indemnify, defend, and hold harmless MyVibeCodedApp, its founders, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights.

11. 🚪 Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms of Service
Submission of prohibited content
Fraudulent, abusive, or illegal activity
Non-payment of subscription fees
Extended inactivity

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

12. ⚖️ Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in Ontario, Canada, in accordance with the applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. 🔄 Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date, and/or by sending an email to your registered address.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
